EULA

Introduction

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and Swiftrix ("Company", "We", or "Us") governing your use of the Swiftrix software application ("Software" or "Swiftrix"). By downloading, installing, or using Swiftrix, you agree to be bound by the terms of this EULA, our Privacy Policy, and our Terms of Service.

License Grant

  1. License:
    • We grant you a non-exclusive, non-transferable, revocable license to download, install, and use Swiftrix for personal, non-commercial use, subject to the terms and conditions set forth in this EULA.

User Obligations

  1. Compliance with Terms:

    • You must comply with all terms set forth in our Terms of Service and Privacy Policy, including but not limited to restrictions on account sharing, reverse engineering, and unauthorized modifications.

  2. Account Termination:

    • We reserve the right to terminate any account that breaches our terms. Any such termination may result in the loss of access to Swiftrix and any in-app purchases made.

  3. Prohibited Activities:

    • You agree not to engage in activities such as reverse engineering, modifying the Software, disrupting our services, or using web proxies to monitor or analyze our traffic.

In-App Purchases

  1. Swiftrix Currency:

    • Swiftrix is free to download. You can purchase an in-app currency called Swiftrix, which can be used to buy optimizations in our shop. All in-app purchases are final and non-refundable.

  2. Usage of Swiftrix Currency:

    • Any items purchased with Swiftrix currency are accessible only until your account is terminated or closed. These items will not be transferred to a new account under any circumstances, except in cases warranted by a technical fault on our end.

Privacy and Data Collection

  1. Data Collection:

    • We collect and store personal information such as username, email, and password (hashed for security). We also collect hardware IDs, log user activities, and track in-app purchases as described in our Privacy Policy.

  2. Data Usage:

    • We use collected data to improve our services, track app usage, and ensure account security. For more information, please refer to our Privacy Policy.

Support and Maintenance

  1. Service Downtime:

    • Our services may experience downtime, and we are not obligated to provide an ETA for restoration. Extended downtime will be communicated through our updates section in the news tab.

  2. Support:

    • Issues or concerns should be reported through our Discord server or other secured communication channels. Harassment of our staff, affiliates, or related individuals is prohibited.

Limitation of Liability

  1. No Liability for Unofficial Downloads:

    • We are not liable for any issues arising from unofficial downloads of Swiftrix. Support will not be provided for software obtained from unauthorized sources.

  2. Disclaimer of Warranties:

    • The Software is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Termination

  1. Termination:
    • This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Software and destroy all copies of the Software.

Governing Law

  1. Governing Law:
    • This EULA shall be governed by and construed in accordance with the laws of California, without regard to its conflict of laws principles.

Changes to this EULA

  1. Modifications:
    • We reserve the right to modify this EULA at any time.
